These terms and conditions ("T&Cs") apply to the use of the Giant Bear website operated by Craftco Ltd, company registration number 15013850. Registered address at Level 1, The Mailbox, 3 Wharfside Street, Birmingham, B1 1RD. By accessing the Giant Bear website and/or placing an order, you agree to be bound by these T&Cs.
1. Ordering from Us:
1.1. After placing an order, you will receive an e-mail from us acknowledging that we have received your order.
1.2. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an email confirming the shipment of your order.
2. Pricing & Availability:
2.1. All prices are inclusive of VAT at checkout unless otherwise stated or if you live outside of the United Kingdom.
2.2. Product availability is not guaranteed. If a product is not available when your order is being processed, we will notify you by email the estimated lead time.
3. Delivery:
3.1. Delivery charges and timescales vary depending on the type of products ordered, the service you select, and the delivery address.
3.2. We shall not be liable for any delay in delivery of the goods that is caused by a circumstance beyond our control or your failure to provide us with adequate delivery instructions or any other instructions relevant to the supply of the products.
3.3. For international orders, once the goods arrive at the destination port, the shipping company will contact the customer to arrange payment of any applicable local customs charges or duties and to coordinate delivery to the specified address. It is crucial that the customer communicates with the shipping company promptly to avoid incurring storage fees. The customer is responsible for any storage costs, destruction of goods fees, or any other charges imposed by the shipping agent. Craftco Ltd. is not liable for these additional costs.
4. Return & Cancellations Policy:
4.1. Please refer to our Return Policy for information about returning products.
4.2. Due to the nature of our sculptures, custom-made sculptures, and made-to-order products including the 50cm, 135cm and 165cm bears, we do not accept cancellations once an order has been confirmed and production has commenced.
4.3. Custom-made items are commissioned and crafted based on individual specifications and as such, cannot be cancelled or changed once the order has been placed.
4.4. In the event of an exceptional circumstance where a cancellation request for a bespoke or made-to-order item is made prior to production commencement, we reserve the right to apply a cancellation fee to cover any administrative costs or losses incurred.
5. Intellectual Property:
5.1. All intellectual property rights concerning this website's design, text, graphics, and other content belong to Craftco Ltd or its licensors. The website is protected by copyright laws.
5.2. Permission is granted to users to electronically copy or print portions of this site for their own personal, non-commercial use. Any other use of materials on this site without prior written consent from Craftco Ltd is strictly prohibited.
6. Privacy & Data Protection:
6.1. All personal data is handled and stored in accordance with our Privacy Policy.
7. Liability:
7.1. Craftco Ltd's total liability for any claim shall not exceed the price of the goods supplied by Craftco Ltd to the customer.
7.2. Craftco Ltd shall not be liable for any consequential loss whether this arises from a breach of duty in contract or any other way.
8. Chargebacks:
8.1. By making a purchase from Craftco Ltd, the customer agrees to adhere to our Terms and Conditions. In the event that the customer initiates a chargeback on their card that is found to be in violation of these Terms and Conditions, the customer agrees to be liable for the full amount of the original purchase, as well as any additional costs incurred by Craftco Ltd. as a result of the chargeback, including but not limited to administrative fees, legal fees, and any other expenses related to the recovery of funds. This clause does not affect the customer's statutory rights under UK law.
9. Law & Jurisdiction:
9.1. These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
9.2. In the event that Craftco Ltd. is required to initiate legal proceedings against the customer to recover any outstanding amounts or enforce the terms of this agreement, the customer agrees to be liable for all reasonable legal costs incurred by Craftco Ltd. in addition to the amount being claimed. This clause does not affect the customer's legal rights, including the right to challenge or defend against such proceedings as provided under UK law.
10. Changes to the Terms & Conditions:
10.1. We reserve the right to modify these T&Cs at any time without notice to you. Any modifications will be effective once they are posted on the Giant Bear website.
11. Mobile Terms of Service
11.1. The Giant Bears mobile message service (the "Service") is operated by Craftco Ltd (“Giant Bears”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
11.2. By consenting to Giant Bears’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Giant Bears through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
11.3. You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Giant Bears. Your participation in this program is completely voluntary.
11.4. We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
11.5. You may opt-out of the Service at any time. Text the single keyword command STOP to Giant Bears or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Giant Bears mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.
11.6. For Service support or assistance, text HELP to Giant Bears or email sales@giant-bears.co.uk.
11.8. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
11.9. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
11.10. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
